This Auction is set with a "Soft Close": Any bid received within the last three(3) minutes of any property's scheduled close will reset the clock to three(3) minutes until closing, allowing bidding to continue until there are no further bids. In the unlikely event of a technical failure, we reserve the right to reschedule the bidding to a later date.
TERMS OF SALE
1. REGISTRATION: On-li ne Auction at www.laibids.com. All registering bidders must submit a valid credit card that will be authorized in the amount of $500. This is an authorization only to validate identity and competency and will not be charged. It may, however, temporarily make that amount unavailable to you on your card. It does require you to completely and accurately provide us with a full name and correct address. If you are having trouble getting registered, you can call the office of Lambrecht Auction (607) 865-6951 for assistance. The Initial Deposit outlined below must be submitted by cash or check. Final payment must be in guaranteed funds.
2. ELIGIBLE BIDDERS:
All persons are entitled to bid at Auction on said parcels except:
a) The members of the Delaware County Board of Supervisors and their spouses and/or significant others;
b) The Delaware County Treasurer and the employees of Delaware County Treasurer's office and their spouses and/or significant others;
c) The Delaware County Real Property Tax Services Director and the employees of the Delaware County Real Property Tax Services office and their spouses and/or significant others;
d) Delinquent taxpayers and their spouses and/or significant others with reference to a parcel owned in Delaware County which resulted in the County acquiring the property;
e) Any person(s) who have defaulted in the past 3 years on bids at previous County tax Auctions, and;
f) Items d and e above apply to that individual and their spouses and/or significant others interest (shareholder), partnership and/or ownership of, including but not limited to any business, Corporation, LLC or LLP.
3. REPRESENTATION OF COUNTY:
There is no representation made as to:
a) The condition of the property or any buildings or structures thereon or that there are any buildings or structures thereon
b) Access to the property
c) Its size or configuration
d) Flood plain status
e) Its lien's status
f) The ownership of any personal property that may be located on the property
4. OCCUPIED PREMISES:
Each parcel is sold "as is". If a parcel is occupied, it is the responsibility of the purchaser to terminate the occupancy and/or to return personal property.
5. PAYMENT OF PURCHASE PRICE:
a) Initial Deposit: Bidders shall deposit with Lambrecht Auction & Real Estate Co. part of the amount of the bid described as follows:
Amount of Bid Amount of Deposit
$500 or less Full amount of bid + 10% Buyer Premium
$5,000 or less $500 + 10% Buyer Premium
Greater than $5,000 10% of the bid + 10% Buyer Premium
Examples: $3,000 bid = $800 ($500 + $300) or $15,000 bid = Deposit of $3000 ($1500+$1500)
The remainder is due within 20 days. It is payable by bank check, money order, or other form of guaranteed funds to: Delaware County Treasurer - 111 Main Street (PO Box 431), Delhi, NY 13753 (607) 832-5070.
***The 10% Buyer Premium is part of Lambrecht Auction & Real Estate’s fee and is not part of the purchase price, nor will it be credited back of the remainder due in 20 days.***
b) If payment is not made within said time, the bid shall be rejected. The down payment will be retained as liquidated damages, and such defaulting purchaser may be responsible for other charges.

7. DEED RECORDING:
All deeds are quitclaim deeds, conveying the interest that the County of Delaware has in the property to the successful bidder. The County Treasurer will record all deeds. You will receive your deed from the County Clerk's Office by mail.
Deed Transfer: There is no formal closing. After the 20 days to pay, the county will prepare and file the Quit Claim Deed at the Delaware County Clerk's Office. Filed Deed will be received by buyer in the mail.
Possession of premises shall be delivered on passing of deed.
8. PURCHASERS RESPONSIBILITY:
From the date of the transfer, the purchaser will be responsible for any and all expenses of the property.
9. DEFAULT BY PURCHASER:
Default by the purchaser of failure to meet the terms and procedure s of this sale will result in forfeiture of the required deposit. It also disqualifies the purchaser from bidding at the tax sales for three consecutive years.
Buyer acknowledges that 2024 NYS Law allows former owner to redeem this County-Owned Tax Sale real property until the passing of the deed.
